Three Foreign Winter Olympic Athletes Test Positive for Covid-19 (Caixin)

Three foreign athletes slated to participate in the 2022 Beijing Winter Olympics have tested positive for Covid-19 this month, the organizing committee announced at a press conference Thursday. All three cases were asymptomatic and the three infected athletes have been isolated for medical observation at a designated hospital, Beijing organizing committee officials said. The first case was a foreign athlete scheduled to participate in sledding event who tested positive after arriving in China on a chartered flight on Nov. 4. On Nov. 11, it was confirmed that a close contact of that athlete was infected. The third case was reported Tuesday in Beijing's northern Yanqing district, where the Olympic sledding events are being held. The three athletes entered China for early training before the Winter Olympics kick off in early February. According to the committee, all athletes coming into the country for the games will be managed under a what officials are calling a "closed loop," in which the athletes will be transported in designated vehicles, stay in designated hotels or Olympic villages, and compete in specific competition zones. None will be allowed to take public transportation.

Beijing Orders Tutoring Companies to Cap Fees (Caixin)

Authorities in Beijing will put a cap on after-school class fees in a bid to guarantee more equitable access to school curriculum-based tutoring, as part of efforts to flesh out the current overhaul of the private education sector. The Beijing Municipal Commission of Development and Reform said in a draft document unveiled Tuesday that after-school classes, both online and offline, will be subject to a government pricing guide that sets benchmark and floating fees, with prices capped at 10% over the benchmark. The pricing guide said the city's development and reform departments and education administrative departments would set a benchmark price for offline classes with 10 to 35 students, while pricing for the other types of classes would be calculated using a yet to be defined "price ratio." The document, which is available for public comment until Dec. 15, came out not long before the year-end deadline for after-school institutions to register as nonprofit entities in order to gain government permits, as required by the central government's sweeping "double reduction" policy issued in July. Specific pricing standards will be introduced "in the near future," according to Tuesday's document, which notes that the pricing guide "provides long-term targeted regulation" for the city's after-school tutoring institutions. The statement added that the guidance helps "guide training institutions to return to the attributes of public welfare." A staff member at the city's education commission told Caixin that the government pricing guide will be calculated based on after-school tutoring entities' reports of their operation costs. The source said that prices will likely be "no more than 100 yuan per class." Prior to the authorities' efforts to rein in the big-money private education sector, there has been huge demand for tutoring in China as affluent parents seek additional education resources for their kids, especially one-on-one tutoring and small classes that cost thousands of yuan, amid an extreme imbalance of education resources across the country. The pricing cap and ongoing pandemic may result in more tutoring classes moving online, while one-on-one tutoring and small classes could be gradually eliminated due to high hiring costs. The source from the city's education commission said that the pricing cap means that online classes that can increase attendance numbers "infinitely" will be the most economical. Hence, government intervention could push the tutoring sector to change its mindset from "training for excellence" to "helping students catch up," thereby promoting education equality with its "complementary status." According to Tuesday's draft document, authorities from different departments will work together to supervise after-school tutoring institutions' revenue, costs, profits and related transactions, as well as their implementation of government policies. The plan also includes strict management of such institutions' operating costs. The document requires that average employee salaries should not be "significantly higher" than those of employees in nonprivate education companies in the city, who earned an average of 200,000 yuan last year, according to official data.

China Issues Guidance on Anti-Monopoly Compliance Abroad (Caixin)

China's top market regulator issued guidance Thursday for domestic companies to step up awareness of overseas anti-monopoly compliance and guard against legal risks abroad. According to the document, the form of anti-competitive behavior is not limited to written agreements but also includes oral agreements and coordinated actions. Most jurisdictions also regulate vertical monopoly arrangements, such as resale price maintenance, the State Administration for Market Regulation (SAMR) said in the guidance. Some jurisdictions define different degrees of criminal responsibility for monopolistic actions, the document says. Individuals involved in monopolistic behavior, such as senior managers and those directly responsible, potentially face fines or even imprisonment. Penalties range up to $100 million for corporate offenders and up to $1 million for individuals with a maximum prison term of 10 years. Most jurisdictions impose large fines for monopolistic behavior, some as much as 10% of a company's total global turnover in the previous year, the administration said. China has been pursuing an expanding crackdown on market monopolies and anti-competitive behavior in the internet platform industry. In April, the SAMR fined Alibaba a record 18.2 billion yuan ($2.8 billion) for violating antitrust laws, marking a seismic moment in the government's quest to rein in monopolistic behavior by online platforms. That was followed by more probes and punishments of big companies including social media giant Tencent and online food delivery service Meituan. In July, U.S. President Joe Biden signed an executive order on promoting competition in the American economy. The order directs various federal agencies to combat anti-competitive conditions affecting the U.S. economy. Analysts said the order may cool future merger and acquisition activities involving foreign buyers.

Alibaba Stock Tumbles After Softer Growth Forecast (Caixin)

China's e-commerce giant Alibaba Group Holding Ltd. slashed its full-year revenue forecast Thursday while posting weaker-than-expected September quarter results, reflecting slowing economic growth and regulatory headwinds. The company reduced its guidance for revenue growth in the current fiscal year to between 20% and 23% year-on-year, citing "macroeconomic conditions and the competitive landscape." It previously forecast annual revenue growth of 29.5%. Alibaba's American depositary shares closed down 11% Thursday at $143.6 apiece. Alibaba reported fiscal second-quarter net income of 5.4 billion yuan ($833 million), down from 28.8 billion yuan a year earlier. Earnings per share fell 38% from a year ago and missed analysts' estimates. Revenue for the September quarter rose 29% year-on-year to 200.7 billion yuan, also falling short of expectations. Alibaba cited general economic fluctuations, the impact of the Covid-19 pandemic, changes in laws, regulations and the regulatory environment among factors that affected operations. Along with rivals such as Tencent Holdings and Meituan, Alibaba and China's major tech companies are under closer regulatory scrutiny amid the government's year-long crackdown on anti-competition practices, which led to a record $2.8 billion fine against Alibaba earlier this year. Revenue from the core commerce segment totaled 171.2 billion yuan in the September quarter, an increase of 31% from the same period last year and contributing 85% of total revenues, Alibaba said. Cloud computing revenue rose 33% to 20 million yuan, representing 10% of total revenue. "Alibaba continued to firmly invest into our three strategic pillars of domestic consumption, globalization and cloud computing to establish solid foundations for our long-term goal of sustainable growth in the future," Alibaba Chairman and CEO Daniel Zhang said in a statement. Annual active consumers of Alibaba's ecosystem around the world reached 1.24 billion for the 12 months ended Sept. 30, an increase of 62 million from the 12 months ended June 30.
